Terms of Service
Last updated: October 2, 2026
1. The agreement
These Terms of Service ("Terms") are an agreement between you and Abdul Waris, an individual sole proprietor based in Pakistan, trading as Insetix ("Stunda", "we", "us"). They cover the Stunda desktop app, the web app at app.stunda.io, our API and MCP server, and this website (together, the "Service").
By creating an account, ticking the box to accept these Terms, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for an organization, "you" includes that organization. If you do not agree, do not use the Service.
Terms version: 2026-10-02.
2. Eligibility
- You must be at least 18 years old.
- If you accept these Terms for a company or other organization, you confirm you have authority to bind it.
- You may not use the Service if the law where you live forbids it, or if you are subject to sanctions that would prohibit us from dealing with you.
3. Accounts
- Give accurate information and keep it up to date.
- Keep your password, sign-in links and API tokens secret. You are responsible for activity under your account.
- One person per account. Do not share an account or create one for someone else without their knowledge.
- Tell us at help@stunda.io straight away if you think your account has been compromised.
4. Tracking other people
If you invite people into a workspace and track their work (a "workspace customer"), you are responsible for doing so lawfully. In particular, you must:
- Give every tracked person any notice the law requires before tracking starts, including what is collected (for example, app names, window titles, browser addresses, input counts and, if enabled, screenshots), who can see it, and why.
- Obtain any consent the law requires, and have a lawful basis for the tracking.
- Comply with all laws that apply to monitoring workers, including employee electronic-monitoring notice laws (such as those in New York, Connecticut and Delaware), the GDPR and UK GDPR, and any employment, labor or works council rules.
- Track only your own employees, contractors or others who work for you, and only in connection with that work.
- Never use the Service covertly or deceptively, and never hide it from the people being tracked.
- Not turn on screenshots for anyone without first telling them that screenshots will be taken.
- Answer tracked people's requests about their data, as the controller of that data.
We may suspend a workspace that we reasonably believe is tracking people unlawfully.
5. Acceptable use
You must not:
- Use the Service for anything unlawful, harmful, fraudulent or deceptive, including stalking or monitoring anyone without their knowledge.
- Upload malware, or content you have no right to use.
- Try to access accounts or data that are not yours, probe or break our security, or get around plan limits.
- Interfere with the Service or overload it, including through automated access beyond normal use of our API.
- Reverse engineer the Service except where the law allows it despite this restriction.
- Resell or sublicense the Service without our written permission.
- Use the Service to build a competing product, or to fake activity (for example, with input simulators).
6. Plans, billing and auto-renewal
Automatic renewal. Paid plans are subscriptions billed monthly or annually. Your subscription renews automatically at the end of each billing period for the same period length, and you will be charged the then-current price for your plan and seats, until you cancel. You can cancel at any time online in the web app (Settings, Billing). Cancellation takes effect at the end of the current billing period, and you keep paid access until then. For annual plans, you will receive a reminder email before each renewal.
- Merchant of record. Paid plans are sold by Polar, which acts as merchant of record and reseller. Polar processes your payment, charges any applicable sales tax or VAT, and issues your receipts. Your purchase is also governed by Polar's Buyer Terms, and Polar handles your payment data under its own privacy policy.
- Prices are shown on our pricing page and at checkout, and do not include taxes unless stated. Taxes are added where applicable.
- Team seats. Team plans are priced per person. When you add seats, the extra seats are charged immediately, prorated for the rest of the current billing period. Removing seats takes effect as shown in the app.
- Upgrades and downgrades take effect as described in the app when you make the change.
- Price changes. We will give you at least 30 days' notice by email before a price increase applies to your subscription. The new price applies from your next renewal after the notice period. If you do not agree, cancel before then.
- Failed payments. If a renewal payment fails, Polar may retry it, and paid features may stop if payment is not completed.
7. Cancellation and refunds
If this is your first paid Stunda subscription, you can ask for a full refund within 14 days of the initial purchase by emailing help@stunda.io. Otherwise, payments are non-refundable and we do not give refunds or credits for partial billing periods, unused seats or unused time, except where the law requires it. This includes any statutory right of withdrawal you have as a consumer in the EU or UK.
Refunds are paid by Polar to your original payment method. Cancelling stops future renewals; it does not by itself refund the current period.
8. Free plan
The Free plan is free with no time limit. It has limits, for example one user, a monthly invoice limit, a small daily number of AI requests, and no screenshots or CSV export. The current limits are on our pricing page. We may change Free plan features or limits with reasonable notice.
9. AI features
- AI features (such as digests, the assistant, suggestions and report summaries) generate output automatically. AI output can be inaccurate, incomplete or out of date. Review it before you rely on it, send it to anyone, or bill or pay based on it.
- The assistant only makes changes you confirm. You are responsible for the actions you confirm.
- What we send to our AI provider is described in our Privacy Policy. You can switch AI features off in your settings.
10. Invoices, payroll and reports
Stunda's invoices, pay run calculations, exchange rates, reports and activity scores are tools to help you. They are not tax, legal, accounting, payroll or employment advice. You are responsible for checking that the figures, rates, taxes and wording are correct and that they meet the laws that apply to you, and for any decisions you make about people based on tracked activity. Stunda does not send payments.
11. Your data
- You own the data you and your workspace members put into the Service ("Customer Data").
- You give us a worldwide, non-exclusive license to host, copy, process, transmit and display Customer Data only as needed to provide, secure and support the Service, and as described in our Privacy Policy.
- You are responsible for your Customer Data and for having the rights and permissions needed to give it to us, including data about your members and clients.
- We may use aggregated data that does not identify you or any person to run and improve the Service.
12. Data Processing Addendum
If you use a workspace to process personal data about other people (for example, your team members), our Data Processing Addendum ("DPA") forms part of these Terms and applies automatically. Where the DPA and these Terms conflict about personal data, the DPA wins.
13. Feedback
If you send us ideas or feedback, we may use them without any obligation to you.
14. Third-party services
The Service works with services we do not control, such as Google and GitHub sign-in, Polar checkout, and AI clients you connect through our API or MCP server. Your use of them is governed by their terms. We are not responsible for them or for what they do with data you choose to send them.
15. Our property
The Service, including its software, design and brand, belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable, revocable right to use it under these Terms. We keep all rights not expressly granted.
16. Availability and changes to the Service
We work to keep the Service available, but we do not promise it will be uninterrupted or error-free. The desktop app keeps working offline and syncs when it reconnects. We may change, add or remove features. If we remove a major paid feature you rely on, we will give you reasonable notice, and you may cancel.
17. Suspension and termination
- You can stop using the Service and delete your account at any time in Settings.
- We may suspend or end your access if you seriously or repeatedly break these Terms, fail to pay, create risk or legal exposure for us or others, or if the law requires it. Where reasonable, we will warn you first and give you a chance to fix the problem.
- If we end your access for a reason other than your breach, we will give you at least 30 days to export your data, and refund any prepaid fees for the unused period.
- After termination, we delete your data as described in our Privacy Policy.
- Sections that by their nature should survive termination (including payment owed, disclaimers, limitation of liability, indemnification and governing law) survive.
18. Disclaimer
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Service, tracked time, activity scores, AI output, invoices or calculations will be accurate, complete or error-free, or that the Service will be uninterrupted or secure.
19. Limitation of liability
To the fullest extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Service or these Terms, even if we were told they were possible; and (b) our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the fees you paid us for the Service in the 12 months before the event giving rise to the claim, or US$100.
Some laws do not allow these exclusions or limits. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your statutory rights as a consumer.
20. Indemnification
To the extent permitted by law, you will defend and indemnify us against any third-party claims, losses, fines and reasonable costs (including legal fees) arising from: (a) your Customer Data; (b) your tracking of other people, including any breach of section 4 or of employee-monitoring, privacy or employment laws; (c) your breach of these Terms; or (d) your violation of any law or third-party right. This section does not apply to consumers where the law does not allow it.
21. Disputes
If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring claims in your local courts where the law allows.
Before starting a formal dispute, please email help@stunda.io so we can try to resolve it informally within 30 days.
22. Changes to these terms
We may update these Terms. We will post the new version here with a new "Last updated" date. For material changes, we will give notice by email or in the app before they take effect, and you will be asked to accept the new Terms in the app to keep using it. If you do not agree, stop using the Service and cancel your subscription. Changes do not apply to disputes that arose before them.
23. General
- Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, sale of assets or reorganization, or to a company we set up to run Stunda.
- Severability. If any part of these Terms is unenforceable, the rest stays in effect.
- No waiver. Not enforcing a right is not a waiver of it.
- Entire agreement. These Terms, the Privacy Policy, the DPA (where it applies) and any order you place form the entire agreement between us about the Service.
- Notices. We send notices to your account email or show them in the app. Send notices to us at help@stunda.io .
- Export and sanctions. You will comply with export control and sanctions laws, and will not use the Service in or for a sanctioned country or person.
- Force majeure. Neither of us is responsible for delays caused by events beyond reasonable control.
- No third-party beneficiaries. Nobody else has rights under these Terms.
- Language. These Terms are written in English, which controls if there is a translation.
24. Contact
